One of our favorites posts of 2007 was our January item on New Orleans lawyer Jim Garner, who successfully moved the court to delay a court hearing because the Saints were playing in the NFC Championship game.

If imitation is the sincerest form of flattery, Garner should be delighted to see this motion to delay a trial, posted by Above the Law earlier today. Stephen Babcock, a lawyer in Baton Rouge, filed the motion yesterday in a case set to go to trial on Jan. 7, the same day that LSU is set to play Ohio State in the BCS National Championship game.

In noting the upcoming gridiron battle, Babcock engages in some jawboning by including a footnote for OSU calling the team “‘Slowhio’ due to their perceived lack of speed on both sides of the ball.” He also says his opposing counsel are “self-professed LSU fans” who don’t object to delaying the trial. He footnotes this, too:

All counsel are veteran member of the T.P.N. (See www.tigerpimpnation.com), which is famous for touring one SEC away game per year, but is making a rare in-state exception for this BCS National Championship game. See also Bourbon Street Blues Club (2nd Floor) (1/7/2008 12:30 p.m. et. seq.)

“All counsel to this matter unequivocally agree that the presence of LSU in the aforementioned contest of pigskin skill unquestionably constitutes good grounds therefor,” wrote Babcock in a memorandum in support of the motion. “In face we have been unable through much imagination and hypothetical scenarios to think of a better reason.” Apparently, neither could Judge Alvin Batiste, who signed an order delaying the trial.
