A Houston-based generator dealer has filed a lawsuit charging the Louisiana Department of Natural Resources with refusing to pay nearly $3.2 million for generators it bought after Hurricane Gustav. Generator Supercenter, which has offices in Baton Rouge, filed the suit in the 19th Judicial District Court earlier this week. According to the suit, the state had a contract to buy 68 generators after the hurricane from Generator Supercenter, but a competitor tried to muscle the company aside. The state ordered the generators from a competitor and refused to pay after Generator Supercenter delivered its order. “When everyone was in the dark, the state begged Generator Supercenter to deliver the generators at any cost, but now the state is hiding behind technicalities regarding the precise delivery time of the generators,” says attorney Stephen Babcock, who represents the generator company. Claims for with the Department of Natural Resources and the Division of Administration have been denied, forcing the company to take the state to court. The DNR was unable to provide a comment before deadline.
