How we get paid sets us apart
Our entrepreneurial approach extends to the cutting-edge, flexible fee arrangements that we have always offered. We have a collaborative process in which payments are discussed upfront, so there are no surprises. We also create fee packages specifically tailored to each client’s situation, do not charge for consultations and are particularly skilled at finding ways to share litigation costs with our clients. We often work on a contingency basis, in which we are paid solely for the results we produce, not our time.
Babcock Partners is able to operate this way because we keep our priorities straight, staff lean, and use technology to our best advantage while avoiding inefficiency at every turn.
Upon request, we will prepare litigation budgets for our clients, but we prefer to work on a fixed-fee or contingency basis that places the risk of inefficiency on us and allows our clients to accurately budget for a case.
Our lean and agile approach makes this possible
About half of our time as a firm is spent in handling contingent fee matters for commercial and individual plaintiffs. Since we prepare these cases for trial on our own dime, we know how to be efficient and we insist that everything our firm does be outcome-determinative.
At our core, we are stand-up jury trial lawyers, not big firm discovery litigators and motion drafters. Everything we do is designed to prepare us to persuade a jury.
Along the way, we conduct minimal discovery, especially depositions. The depositions we do take are short. Excessive questioning of witnesses, particularly experts, serves only to educate them on our position, and the more they know about our position, the less likely we are to create surprises at trial.
But not always
Common sense dictates that fee arrangements like those described above will not work for every case. In those instances, we also work on traditional hourly rates or flat fees. This is often the case with institutional purchasers of legal services like insurance companies who often lack the flexibility necessary to engage us on a contingent basis, and in cases that we defend, rather than prosecute.
